Volunteer Waiver, Release of Liability & Assumption of Risk

Please read this agreement carefully. When you sign up for a volunteer event, you will be asked to click I Acknowledge to confirm that you have read and agree to the terms below. That acknowledgment constitutes your legally binding electronic signature.
1. Parties
This Volunteer Waiver and Release of Liability (“Agreement”) is entered into between Project Helping, a Colorado nonprofit organization (“Organization”), its partner organizations that utilize the Kynd Hub event management platform (“Partner Organizations”), and you, the individual completing this digital acknowledgment (“Volunteer”).
2. Description of Volunteer Activities
Volunteer activities may include, but are not limited to: general community service, physical and outdoor activities, activities involving vulnerable populations (including seniors, individuals experiencing homelessness, individuals with disabilities, and youth), and any other activities organized or facilitated by Project Helping or its Partner Organizations through the Kynd Hub platform.
3. Assumption of Risk
I acknowledge and understand that volunteer activities may involve inherent risks, including but not limited to: physical injury, illness, exposure to communicable diseases, accidents, property damage, and risks associated with working with vulnerable populations. I voluntarily assume all such risks, whether known or unknown, foreseen or unforeseen.
4. Release & Waiver of Liability
In consideration of being permitted to participate in volunteer activities, I hereby release, waive, discharge, and covenant not to sue Project Helping, its officers, directors, employees, agents, and volunteers, as well as any Partner Organizations utilizing the Kynd Hub event management platform, their respective officers, directors, employees, agents, and representatives (collectively, “Released Parties”), from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in volunteer activities, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by Colorado law.
5. Indemnification
I agree to indemnify and hold harmless the Released Parties from and against any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities arising out of my participation in volunteer activities, including reasonable attorneys’ fees, to the extent caused by my own negligence, willful misconduct, or breach of this Agreement.
6. Partner Organizations & Kynd Hub Platform
I understand that some volunteer events may be organized or managed by Partner Organizations that utilize the Kynd Hub event management platform. This Agreement covers all such events and activities, regardless of whether they are organized directly by Project Helping or by a Partner Organization through Kynd Hub. The Released Parties include all such Partner Organizations.
7. Media Release
I grant Project Helping and its Partner Organizations the right to photograph, record, and use my image, likeness, and voice in connection with volunteer activities for promotional, educational, and organizational purposes, without compensation.
8. Health & Medical Authorization
I represent that I am in adequate physical and mental health to participate in volunteer activities. In the event of a medical emergency, I authorize Project Helping or its Partner Organizations to seek emergency medical treatment on my behalf, and I agree to be responsible for any costs incurred.
9. Background Check Consent
For activities involving vulnerable populations, I consent to a background check being conducted by Project Helping or its Partner Organizations as a condition of my participation. I understand that the results may affect my eligibility to volunteer in certain capacities.
10. Code of Conduct
I agree to conduct myself in a professional, respectful, and safe manner at all times. I understand that Project Helping or any Partner Organization reserves the right to dismiss me from a volunteer event for failure to comply with established conduct standards.
11. Minors
If you are under 18 years of age, you confirm that a parent or legal guardian has reviewed this Agreement, consents to your participation, and agrees to be bound by its terms on your behalf. Project Helping reserves the right to require a signed parental consent form prior to participation.
12. Digital Consent & Record Keeping
Clicking I Acknowledge during event registration constitutes a legally binding electronic signature under the Colorado Uniform Electronic Transactions Act (C.R.S. § 24-71.3-101 et seq.) and the federal Electronic Signatures in Global and National Commerce Act (E-SIGN). The acknowledgment, along with the Volunteer’s name, email address, IP address, and the date and time of acceptance, will be recorded and retained by Project Helping as evidence of consent.
13. Governing Law & Severability
This Agreement shall be governed by the laws of the State of Colorado. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.
